March 20, 2019 

The Harlem Township Trustees met in regular session at the Firehouse. 

Trustees Present: David Jackson, Jerry Paul and Bob Singer. 

Fiscal Officer Present 

Public Present: Jon Trainer, Belinda Jackson, Gary and June Jackson, Kevin and Susi Perry, John and Bonnie Kopec, Karen Coffman, Abby Crisp, Diane and Mike Kabler, Warner and Jackie Mackie, Missy Simpson, Juanita Berk, Herman Berk Jr., Raelene Meadows, Michael Chappelear, Michelle Soloman, Dustin Cline, Joni Manson, Cindy Rose, Jim Sommerfeld, Mike Coutinho, Scott Belcastro, Marleen Schiefer, Phyllis Davidson, and Bart Walker. 

Mr. Singer called the meeting to order. The minutes of February 20th, 2019 were approved as sent. Mr. Paul moved to approve said minutes. Motion seconded by Mr. Singer. Motion Passed. 

The Fiscal Officer presented the bills and certified that the amounts were available in the respective accounts to pay said bills. Starting with warrant #10789 and ending in warrant #10826, and Voucher #11-2019 and ending #15-2019, Totals $126,105.86. Mr. Paul made a motion to pay said bills. Motion was seconded by Mr. Jackson. Motion Passed. 

Diane Kabler (resident), Harlem Township Civic Association, made announcement that the clean-up Harlem Township is set for May 4th. 

Melissa Simpson (resident) received a letter regarding sewer and wanted more information. Mr. Singer explained that there is a proposal for this to enter into the Township by Harlem Road and Smothers Road which is by an agreement with City of Columbus. Mike Chappelear (adjacent resident) asked if a resident decides to tap into it if that will cause an annex? Mr. Singer stated it would not annex them. Jackie Mackie (resident) wanted to know if the Township is to remain country. The Board would like to see it remain country, which is the reason they are reviewing the Masterplan and working on putting a committee together to update it. The Board will stay on top of this to do what they can to keep any control they might have. 

At this time, Mr. Singer announced the Trustees will recess the regular portion of the business meeting to hold the hearing for rezone application HTZC 19-01. The hearing for a rezone application from Horace and Tina Henriot, 6351 Harlem Road, Westerville, Ohio 43082, is seeking to rezone 2.156 acres from Current Zoning AR-1 Agricultural Residential to FR-1 Farm Residential. Physical address for the property is 6351 Harlem Road, Westerville, Ohio 43082. After Mr. Jackson read the recommendation of The Harlem Township Zoning Commission and the DCRP. There was nobody present against proposal. Mr. Jackson confirmed this was properly advertised. Mr. Jackson made a motion to approve the Application HTZC 19-01; motion was seconded by Mr. Paul. Roll call vote was held Mr. Singer Aye, Mr. Paul Aye, and Mr. Jackson Aye. Motion Passed. The Applicant was advised there will be 30 days before it takes effect for a resident's right of referendum. 

At this time, Mr. Singer announced the Trustees will open advertised zoning hearing for Application HTZC 19-03. The hearing for a rezone application from Starfall LLC, 1876 Africa Road, Galena, Ohio 43021, is seeking to rezone 11.064 acres from Current Zoning AR-1 Agricultural Residential to FR-1 Farm Residential. There is no physical address for the property. The parcel is listed as Tract 6, Parcel ID # 316-430-02-016-006 on Fancher Road at the corner of State Route 605. After Mr. Jackson read the recommendation of The Harlem Township Zoning Commission and the DCRP. There was public present against proposal. Mike Chappelear asked how these lots will be built upon, as he wonders if flag lots may be used. Mr. Singer explained that the Board is conducting this hearing to address the re-zoning application and not any possible reconfiguration or lot splits of the parcel. The owner will have to meet Zoning requirements when that time comes. Marleen Schiefer (resident) voiced her concerns over the increased traffic at the intersection of State Route 605 and Fancher. Mr. Jackson stated ODOT has submitted for the intersection to receive improvement based on funding. Mr. Paul informed the public that the Township Trustees can make recommendations for the intersection, however it is a County Road and a State Highway, therefore it is not in the Township jurisdiction. Mr. Jackson confirmed this was properly advertised. Mr. Jackson made a motion to approve the Application HTZC 19-03; motion was seconded by Mr. Paul. Roll call vote was held Mr. Singer Aye, Mr. Paul Aye, and Mr. Jackson Aye. Motion Passed. The Applicant was advised there will be 30 days before it takes effect for a resident's right of referendum. 

At this time, Mr. Singer announced the Trustees will open advertised zoning hearing for Application HTZC 19-04. The hearing for a rezone application from Starfall LLC, 1876 Africa Road, Galena, Ohio 43021, is seeking to rezone 10.838 acres from Current Zoning AR-1 Agricultural Residential to FR-1 

Farm Residential. There is no physical address for the property. The parcel is listed as Tract 7, Parcel ID # 316-430-02-016-007 on Fancher Road at the corner of State Route 605. After Mr. Jackson read the recommendation of The Harlem Township Zoning Commission and the DCRP. There was public present against proposal with concerns to driveways. Karen Coffman with Starfall mentioned driveways will need to be approved by the County Engineer and ODOT. Mr. Jackson confirmed this was properly advertised. Mr. Jackson made a motion to approve the Application HTZC 19-04; motion was seconded by Mr. Paul. Roll call vote was held Mr. Singer Aye, Mr. Paul Aye, and Mr. Jackson Aye. Motion Passed. The Applicant was advised there will be 30 days before it takes effect for a resident's right of referendum. 

Scott Belcastro was present to present to the Trustees a newly negotiated contract rate for the Township Electric Aggregation that would be a 24 month program. Mr. Belcastro explained to the Board and public several bids. Mr. Belcastro’s recommendation is to contract with FirstEnergy based on a transmission rate of less than 5 cents per kilowatt hour. Mr. Paul made a motion to accept the new contact with FirstEnergy for the 24 month program. Motion was seconded by Mr. Jackson. Roll call vote was held Mr. Singer Aye, Mr. Paul Aye, and Mr. Jackson Aye. Motion Passed. 

Mr. Singer made a motion to authorize Mr. Jackson to be the authorized signer on behalf of the Board for Township Electric Aggregate contract. Motion was seconded by Mr. Paul. Motion Passed. 

MAINTENANCE: 

Mr. Bart Walker requested the Board’s approval for #8 gravel for dust control at the price of $32 per ton with Mid-Ohio Paving. The approximate tonnage needed is 250 tons. Mr. Jackson made motion to approve purchase of #8 gravel from Mid-Ohio Paving for $32 per ton. Motion was seconded by Mr. Paul. Motion Passed. 

Mr. Walker worked on a drainage issue on Green Cook Road. He will watch the location to see if the improvement continues to function. 

Mr. Walker asked the Board to approve installing a Vibrator in both salt trucks. His recommendation is with Dexter Company at a cost of $1,100 each. Mr. Jackson made the motion to purchase two (2) vibrators with Dexter Company to be installed in each of the dump trucks, at a cost not to exceed $1,100 each. Motion was seconded by Mr. Paul. Motion Passed. 

The Board received a response for the REA (Request Engineer Assistance) for Gorsuch Road (Twp Road #27) but feel they were not looking at the correct section of the Road. Mr. Jackson and Mr. Walker will ask for another review. 

Mr. Walker submitted to ODOT request to evaluate pothole damages at intersection(s) on State Route 605. 

Mr. Paul would like to meet Mr. Walker at the Barnhard cemetery to discuss driveway layout. 

Mr. Paul would like Mr. Walker to install Stop Ahead signs on Green Cook Road for the intersection of Fancher Road. The Board would like a sign on both sides of the Road with reflective facing on the post. 

ZONING: 

Jon Trainer presented the Board with an update of permits that have been issued and status of properties he has followed up on. Enforcement has not been happening since he has been stationed out of Ohio. He provided his schedule to the Board and informed them that they will need to hire a Zoning Inspector as soon as possible. 

Mr. Paul requested Mr. Trainer to check on a status of the PCD on Fancher Road with the Storage units. 

FIRE DEPARTMENT: 

Mr. Paul made the motion to approve an Affiliation Agreement with Delaware Area Career Center, for the purposes of student “on-site” job experience with the Fire Department. Motion seconded by Mr. Jackson. Motion Passed. 

OPERATIONS: 

Mr. Paul made motion to approve paying the materials to restore the Big Tree Bench not to exceed $400. Motion seconded by Mr. Jackson. Motion Passed. 

The Zoning Inspector Bond will expire 4/4/2019. Mr. Paul made the motion to renew the Zoning Inspector Bond. Motion was seconded by Mr. Jackson. Motion Passed. 

The Board received a letter for request for Liquor permit to Centerville Market. After discussion with concerns of parking, the Board would like the Liquor division to have a hearing. Mr. Paul made the motion to request a hearing. Motion was seconded by Mr. Jackson. Motion Passed. Mr. Paul will contact the Prosecutors office. 

Mr. Singer requested Mr. Trainer to post letter on the door regarding debris, in front of the property at State Route 605 and Center Village Road. 

Fiscal Officer announced that the 2017 and 2018 Audit has been completed. 

Fiscal Officer also announced that the Township did receive a $500 refund for the bond from the Delaware County Commissioners for Drainage Petition Gorsuch Joint County #588 Watershed. Mr. Singer is going to inquire time frame of future actions. 

Mr. Jackson mentioned the Board will need to decide at the next meeting what the Township wants to apply for with OPWC. 

Mr. Jackson would like to see Hunt cemetery seeded on the donated section. 

Mr. Paul inquired on the ice Rink. The Board feels it can be taken down. Mr. Singer will contact Mr. Lewis to ask for removal. 

Mr. Paul would like Mr. Walker to evaluate the Track at the park to see if it needs sealed. 

Mr. Singer spoke with Mike Anderson with Concrete Plant. He informed him that they are working on donating it to the Township. 

Mr. Singer wanted to know if the Board is in favor of contacting the Regional Planning to see if they can help with the Comprehensive Plan. Mr. Kabler with Zoning Commission is in favor of this to get professional advice. The Board agreed as well. 

The Board would like Mr. Fling inquire with surrounding Township to their Zoning fees. 

Executive Session was requested by Mr. Singer. Mr. Paul made motion for Executive Session to discuss Personnel Matters with regards to compensation of an Assist Zoning Inspector. Motion was seconded by Mr. Jackson. A Roll Call was held; Singer, Aye; Paul, Aye; and Jackson, Aye. Motion Passed. Invited to stay was Jon Trainer and Julie Debolt. 

Mr. Jackson made a motion to come out of Executive Session. Motion was seconded by Mr. Paul. A Roll Call was held; Singer, Aye; Paul, Aye; and Jackson, Aye: Motion Passed. 

The Board discussed updates to the website, decisions will be made in the future. 

The Board would like Mr. Fling to gather a couple estimates on a deep clean at the Grange. 

Being no further business Mr. Paul made a motion to adjourn. Mr. Jackson seconded motion. Motion passed. 9:35 pm.
