The Harlem Township Trustees met in regular session at the Firehouse.
Trustees Present: David Jackson, Jerry Paul and Bob Singer.
Fiscal Officer Present
Public Present: Dale Fling, Mike Kabler, Abby Crisp, Carl Richison, Raelene Meadows, Tom Nied, and Matt Kurz.
Mr. Singer called the meeting to order. The minutes of June 19th, 2019 were approved as sent. Mr. Jackson moved to approve said minutes. Motion seconded by Mr. Paul. Motion Passed.
The Fiscal Officer presented the bills and certified that the amounts were available in the respective accounts to pay said bills. Starting with warrant #10941 and ending in warrant #10970, and Voucher #30-2019 and ending #35-2019, Totals $127,458.80. Mr. Jackson made a motion to pay said bills. Motion was seconded by Mr. Paul. Motion Passed.
Abby Crisp with the Health District reported there is information on their website regarding Age Friendly assessment, Source Point strategic planning and work groups, Measles in Ohio, and Senior Appliance Pickup.
Mr. Kurz provided the Board with a report of permits and issue(s) he is addressing. Mr. Fling will meet with Mr. Kurz to review ongoing issues in the Township.
Mr. Fling received a proposed contract from Scott Sanders with Regional Planning for planning services between Harlem Township and the Delaware County Regional Planning Commission to update the Comprehensive Plan. The total cost of contract is a maximum fee of $8000. Mr. Sanders advised there are 24 hours currently available and believes the cost for the update will be lower, but for contact purpose made it for the high end. Mr. Paul made a motion to approve the Contract for Planning Services from Delaware County Regional Planning, for the purpose of updating the Comprehensive Master Plan, not to exceed $8,000. Motion was seconded by Mr. Jackson. Roll call vote was held Mr. Singer Aye, Mr. Paul Aye, Mr. Jackson Aye. Motion Passed.
The Harlem Township Board of Trustees is being asked to consider the following: AV Investment, 5700 Sugarwood Drive, New Albany, Ohio 43054, is seeking to rezone 45.567 acres from Current Zoning AR-1 Agricultural Residential to FR-1 Farm Residential. There is no physical address for the property. The property is listed as Parcel ID# 316-230-02-027-000, on Center Village Road west of Harlem Road. Mr. Jackson made a motion to receive the Rezone Application HTZC 19-11. The hearing will be held on Wednesday, August 14, 2019 at 7:00 p.m. at the Harlem Township Firehouse, 3883 South State Route 605, Galena, Ohio 43021. The hearing is open to the public. The application and accompanying documents are on display at the rear door of the Harlem Township Firehouse, 3883 South State Route 605, Galena, Ohio 43021. Mr. Paul seconded the motion. Motion Passed. Mr. Kabler informed the Board there were residents that opposed the rezone.

There is no physical address for the property. The property is listed as Parcel ID# 316-140-01-016-000, and is located at the corner of Green Cook Road and Needles Road. Mr. Jackson made a motion to receive the Rezone Application HTZC 19-13. The hearing will be held on Wednesday, August 14, 2019 at 7:15 p.m. at the Harlem Township Firehouse, 3883 South State Route 605, Galena, Ohio 43021. The hearing is open to the public. The application and accompanying documents are on display at the rear door of the Harlem Township Firehouse, 3883 South State Route 605, Galena, Ohio 43021. Mr. Paul seconded the motion. Motion Passed.
Mr. Fling announced that the Playground equipment at the Park is being installed this Saturday, 7/20/19, and the group is still asking for volunteers to help with the construction.
Mr. Paul met with Mr. Walker and a home owner on Lewis Road regarding a flooding issue. It is suspected that the cause of the backed up water is due to an inadequately sized bridge on SR 37. Mr. Paul instructed the homeowner to contact Delaware County EMA regarding the flood damage to see if they could offer any relief and to contact ODOT with regard to the bridge.
Mr. Jackson has received the OPWC 2020 Road Improvement Program for Montgomery Road. The proposal shows the Township cost at $53,007.00 and the County at $49,220.00. Mr. Jackson made the motion to accept OPWC 2020 Road Improvement Grant Application with Resolution #19-07-17- T9. Motion was seconded by Mr. Paul. Roll call vote was held Mr. Singer Aye, Mr. Paul Aye, Mr. Jackson Aye. Motion Passed. Resolution #19-07-17-T9.
Mr. Jackson received the Authorization Legislation that will allow David Jackson to be authorized Signer for the 2020 OPWC Road Improvement on Harlem Township’s behalf. Mr. Paul made motion to approve Authorization Legislation with Resolution #19-07-17-T10. Motion was seconded by Mr. Jackson. Motion Passed. Resolution #19-07-17-T10
There is also a Cooperation Agreement between Delaware County and Harlem Township for the 2020 OPWC Montgomery Road work. Mr. Jackson made motion to approve the Cooperation Agreement with Resolution #19-07-17-T11. Motion was seconded by Mr. Paul. Roll call vote was held Mr. Singer Aye, Mr. Paul Aye, Mr. Jackson Aye. Motion Passed. Resolution #19-07-17-T11.

Chief Fling received letter of resignation from full-time firefighter/paramedic Shea Shuette, effective July 23, 2019; Mr. Schuette requests to remain as part-time employee.
Chief Fling is requesting the Board’s approval to conditionally hire FF/EMT-P Louis Mittelman, to fill a recently vacated full-time position. Mr. Paul made motion for the Conditional Hire for Full Time FF/EMT-Paramedic to Louis Mittelman, and to waive the background check requirement as we currently have a recent background check on file. Motion was seconded by Mr. Jackson. Roll Call Vote was held; Mr. Singer, Aye; Mr. Paul, Aye; Mr. Jackson, Aye. Motion Passed.
The cellphone provider vendor change has been completed, to AT&T First Net and will be cancelling Sprint service.
Mr. Fling received a change order for the parking lot repaving project with IAP; resulting in an additional amount of $4,790.07 for the handicap accessible entrance, at the rear public entrance to the Township Hall and offices. Mr. Paul made the motion to approve the change order for $4,790.07 from IAP. Motion was seconded by Mr. Jackson. Roll Call Vote was held; Mr. Singer, Aye; Mr. Paul, Aye; Mr. Jackson, Aye. Motion Passed.
Mr. Fling provided the Board with the 1st half payroll summary to date.
Mr. Fling notified the Board that the Township cannot do anything with the issues of the vacated road right-of-ways in Center Village that were previously discussed. Actions to rectify the problem must be addressed by the Delaware County Commissioners. He has notified the property owners and given them contact information for them to pursue with the County.
Township has received copy of the deed for Newcon, LLC/Buckeye Ready-Mix.
Mr. Fling updated the Board regarding the website, and hopes for it to be live soon.
Mr. Fling request the Board to start thinking of expenses for 2020 as will be working on Appropriations soon, as budget is due to be sent to the County Auditor next month, and work on 2020 appropriations will begin shortly thereafter.
The Board discussed accepting the funds from the school memorial fund to the Park Fund. Mr. Paul motion to accept $311.32 from the school memorial fund to the park fund. Motion was seconded by Mr. Jackson. Motion Passed.
Mr. Jackson announced that he has been in contact with Prosecutor’s Office regarding the process of the $5 increase of Permissive Tax that would not go into effect till 2020. Mr. Singer would like to wait to make a decision based on what the State approves and/or changes in the Local Government Funding. The Board agreed.
Mr. Jackson announced there is a drainage petition that may involve an earlier issue in Center Village near the water tower, he will keep the Board informed.
Mr. Paul requested a thank you letter be sent to the Groseclose Family for the flags they put out in the cemeteries for Memorial Day. The Board instructed Mr. Fling to send a letter.
Mr. Singer was contacted by Roger Neibarger, the Big Tree bench is almost finished and would like to know where the Board would like it placed. An option is to locate it next to the school memorial at the park. The Board agreed that location would be fine.
Mr. Paul contacted the property owner at Smothers and Harlem Road to find that he had gravel and dirt donated to him for fill, and there are no decided plans for the parcel at this time.
Mr. Singer discussed the possible change to the rezone fee(s). After much discussion, the Board would like to make the decision at the next regular Board meeting.
Mr. Richison, Board of Zoning Appeals, would like the Board to review the setback guidelines for flag lots.
Mr. Nied asked the Board if there is any way for a traffic light at the intersection of Center Village Road and State Route 605. Mr. Singer advised they have been in contact about this intersection with both the County Engineer’s office and ODOT and they are not proposing a traffic light to be installed at this time.
Mr. Paul asked if Mr. Walker has installed mulch around trees in Park. Mr. Fling informed the Board that Mr. Walker is aware and will take care of it as soon as scheduling allows.
