 May 16, 2018 

The Harlem Township Trustees met in regular session at the Firehouse. 

Trustees Present: David Jackson and Bob Singer. 

Fiscal Officer Present 

Public Present: Dale Fling, Ron Miller, David Miller, Larry Emmert, Diane and Mike Kabler, Caroline Crawford, Mark Crawford, Bart Walker. 

Mr. Singer called the meeting to order. The minutes of April 18th, 2018 and reconvened April 25th were approved as sent. Mr. Jackson moved to approve said minutes. Motion seconded by Mr. Singer. Motion Passed. 

Mr. Jackson made motion to approve legal expense for OPEC litigation to Mazanec, Raskin & Ryder Co., LPA in the amount of $2,657.80. Motion was seconded by Mr. Singer. Motion Passed. 

The Fiscal Officer presented the bills and certified that the amounts were available in the respective accounts to pay said bills. Starting with warrant #10424 and ending in warrant #10463 (warrant #10463 also known as 193-18B), and Voucher #19-2018 and ending #23-2018, Totals $120,920.45. Mr. Jackson made a motion to pay said bills. Motion was seconded by Mr. Singer. Motion Passed. 

Larry Emmert, resident on Hatch Road, voiced his complaint for traffic detouring on Hatch Road from accidents and tree falling that have occurred on State Route 605. He feels that traffic should detour on County Roads. Mr. Singer will contact the Sherriff Department, State Highway Troopers and ODOT to see if anything can be done differently. 

FIRE DEPARTMENT: RTD: Fire 69 EMS 139 Totals 199 

Conditional Hire, Scott ‘Brad’ Lewis, has completed his Conditions and will be working into the scheduling. 

Chief Fling presented to the Board a letter from Lieutenant Tim Neja announcing his retirement from active membership with the Fire Department. He will remain an auxiliary firefighter. 

Mr. Fling presented the Board with a Resolution of Necessity, to move forward with the Replacement Fire Levy for the November 2018 ballot. He first will have to submit to the County Auditor and hopes to have the next resolution at the next meeting to turn in to Board of Election to be put on the ballot. Mr. Jackson made a motion to approve Resolution of Necessity for Levying for the Fire Department not to exceed 4 mills which is a Replacement Tax. Motion was seconded by Mr. Singer. Roll call vote was held Mr. Singer Aye, Mr. Paul Absent, and Mr. Jackson Aye. Motion Passed. Resolution #18-05-16-T10. 

ZONING: 18 permits have been issued this month 

Mr. Trainer will be sending a Violation letter regarding vegetation and debris to the property owner at 3669 State Route 605. 

Mr. Trainer presented the Board with a Resolution Prohibiting the Keeping or Harboring of Barking or Howling Dogs within the Unincorporated Territory of Harlem Township. The Board would like to review the Resolution further and plan to address this topic at the next meeting. 

Mr. Trainer is requesting a special meeting for executive session to discuss Personal Issues at a later date but prior to June 16. The Board will work with him to schedule. He also would like the Board to know that his filing needs are not being met. 

Mr. Kabler updated the Board that Zoning Commission is working on zoning language. Mr. Jackson would like him to review the Planned District(s) language and processes. 


Mr. Walker informed the Board that the rear tires need to be replaced on the road side mower. Current ones are Firestone that are 12 years old. The quotes he received were Firestone at $1,446, Alliance Farm Pro $1,256, and Crop Max $1,156 from Pond Tire. His recommendation is the Firestone. Mr. Jackson made the motion to approve Firestone tire purchase from Pond Tire at the price of $1,446. Motion was seconded by Mr. Singer. Motion Passed. 

Mr. Jackson has received another estimate on the parking lot. The estimates have been close and feels it is time to move forward. Mr. Jackson made the motion to proceed with formulating a competitive bid package with the Prosecutor’s Office. Motion was seconded by Mr. Singer. Motion Passed. 


Mr. Singer made a motion to waive the Grange rental fee to the Buell Family for use of the Grange Hall in honor of the years of service to the Township that Kenneth Buell did for the Township. Motion was seconded by Mr. Jackson. Motion Passed. 

Mr. Jackson has asked the Soil and Water Conservation to attend the June Board meeting to discuss drainage issues on Montgomery Road. 

Mr. Singer had an inquiry on renting the Grange for a fundraiser event. Currently the Grange policy does not permit this type of event. The Board felt they need to follow the current policy. 

Mr. Fling followed up with Recycle bins usage; totals for 2017 were 243,560 lbs and so far first quarter of 2018 is at 92,460 lbs. 

Mr. Jackson made a motion that the two (2) Ford Crown Victoria and the old roadside mower are to be declared Township surplus. Motion was seconded by Mr. Singer. Motion Passed. Mr. Fling will research getting these items sold. 

Website committee has met. The requested items to be changed will be discussed with our webmaster to see what all can be done and an estimated cost to implement the changes. 

Chief Fling provided to the Board and residents at the meeting, a Fire Department overtime breakdown for 2016 and 2017 that was requested by Mark Crawford at the April meeting. 

Being no further business Mr. Jackson made a motion to adjourn. Mr. Singer seconded motion. Motion passed. 7:51 pm.
