Harlem Township Zoning Commission 3883 South State Route 605

Chairman, Mike Kabler, called the September 4, 2018 to order at 7:30 p.m. Mr. Kabler asked for a roll call of members.

Members Present: Robin lobenstein, Joni Manson, Mike Kabler, Tom Nied

Members Absent: Alan Czako

Alternate Present: Bill Needham

Zoning Inspector: Not Present

Public Present: None Present

Commission members discussed the Harlem Township Storage Facility. The Ohio Supreme Court had issued a Writ of Prohibition ordering the Delaware County Board of Elections to remove the referendum from the

November 2018 ballot. The Writ of Prohibition was effective August 21, 2018. Mr. Kabler asked the secretary if she had sent notification to the applicant stating their zoning was effective as of August 21, 2018. Ms. Steele stated she had not sent any letters. Mr. Kabler will check with Dale Fling in regards to the matter.

Mr. Kabler stated there were no new applications at this time.

Commlssion members reviewed minutes for corrections. Ms. Manson made a motion to approve the minutes of the July 9, 2018 workshop meeting as submitted. Ms. Lobenstein seconded the motion. Mr. Kabler asked for a voice vote on the motion, all aye. Motion carried.

Mr. Needham made a motion to approve the minutes of the August 13, 2018 workshop meeting as submitted. Ms. Manson seconded the motion. Mr. Kabler asked for a voice vote on the motion, all aye. Motion carried.

The secretary informed Commission members that Karen Coffman had come in on August 27, 2018 and

officially withdrawn the application for Starfall for the property on State Route 605.

Commission members next discussed the reformatting of the Zoning Resolution. Commission members

agreed the Trustees must approve the reformatting before it is made official. Mr. Nied stated the second page had not yet been corrected. The page indicates Liberty Township instead of Harlem Township. Mr. Kabler will make Mr. Sanders aware of the correction. Commission members had concerns that the printed format does not match the Township's document. Ms. Manson will proof the printed copy. Commission members will

postpone any further action until their October 1, 2018 monthly meeting.

Commission members then discussed the issue of Net Acreage. Mr. Kabler had e-mailed Commission

members with his findings of the 18 townships within Ohio. Seven townships, one of which is Harlem

Township, use net acreage regulations for lots of less than 5.0 acres. Three townships use net acreage

regulations for lots 5.0 acres and larger. Delaware County does not consider net acreage when reviewing an application which has created problems for Harlem Township in the past. Commission members will consider net acreage language when they next submit proposed language changes for application.

Commission members reviewed Draft 9 of Article 8 proposed language changes. Further changes were made. Commission will finalize any further changes at their October 1, 2018 monthly meeting.

Mr. Kabler adjourned the September 4, 2018 monthly meeting at 9:50 p.m.
