Harlem Township Zoning Commission 3883 South State Route 605

November 5, 2018

Chairman, Mike Kabler, called the November 5, 2018 monthly meeting to order at 7:30 p.m. Mr. Kabler asked for a roll call of members.

Members Present: Tom Nied, Alan Czako, Mike Kabler, Robin Lobensteln, Joni Manson

Alternate Present: Bill Needham

Secretary: Sherrie Steele

Zoning Inspector: Jon Trainer

Public Present: Jack Steven Decker, 5501 Miller Paul Road, Westerville, OH 43082

Mr. Kabler stated the Commission would begin tonight's meeting with the presentation of an application.

Jack Steven Decker, 5501 Miller Paul Road, Westerville, Ohio 43082 presented an application to rezone 5.284 acres on Robins Road. Mr. Decker stated the property has a 400' road frontage. Mr. Decker stated he had gone out and knocked on doors and had spoken to 5 of the

surrounding neighbors. Mr. Decker gave the secretary check# 103 for$ 500.00 for the

application fee and check # 104 for$ 660.00 for the acreage fee.

Mr. Kabler stated Mr. Decker had used the Review Team for the application. Commission

members looked at the application to make sure all pertinent documents had been included.

Mr. Nied stated she had a question regarding the General Warranty Deed and stated the deed shows a parcel number that is not within Harlem Township. Mr. Trainer stated he would verify the number. Mr. Trainer stated the number on the General Warranty Deed was for Orange

Township and not Harlem Township. Mr. Trainer stated the correct parcel number is 316-340- 01-005-001.

Mr. Decker asked if it would be okay for him to step out and call Joe Clase, Land 4 U, who had prepared the application for Mr. Decker. Mr. Kabler stated that would be okay as Mr. Decker had gone before the Review Team and this error was not caught at that time.

Mr. Kabler stated the Commission would continue with the meeting until Mr. Decker came

back.

Mr. Trainer presented his Zoning Report dated November 5, 2018. Mr. Trainer stated as of

October 3, 2018 there have been twelve zoning permits issued. Six permits were for Single

Family Residences and six permits for Accessory Buildings. Mr. Trainer stated three of the

Accessory Building permits were issued today.

Mr. Trainer stated in regards to Enforcement Issues the Trustees will be meeting next week to discuss whether or not to take action in Common Pleas Court for the property at 5180

Smothers Road. The property owner has refused to cease activity after having been cited.

Mr. Trainer stated he, Jerry Paul and Dave Jackson met with Mr. Smith on Robins Road In

regards to the two barking/howling dog citations he has received. Mr. Smith has built an 8'

high fence around the open side of the kennel. Mr. Smith intends to build a permanent wall as money allows for.

Mr. Decker came back to the meeting and informed Commission members that Joe Clase will have the error on the General Warranty Deed corrected prior to the hearing.

Commission members set December 3, 2018 at 7:45 p.m. for the Decker hearing, application HTZC 18-03. Mr. Kabler stated that if for some reason Mr. Clase could not obtain the corrected General Warranty Deed by that evening, the Commission would recess the hearing as Mr.

Decker had gone before the Review Team.

Mr. Nied stated Homewood Corporation has applied for permission to build a Common Access Drive (CAD) off of State Route 605 for the 38 acre parcel that faces out on State Route 605. Mr. Nied stated Homewood has received primary approval for the CAD Mr. Nied stated the land would be divided into 5 parcels with a few acres being sold to adjacent property owners.

Mr. Nied asked Mr. Trainer if for next year he could show an accumulative number for how

many Single Family Residence and Accessory Buildings are being issued for the Township. Mr. Trainer stated there would be no problem in accommodating the request.

Mr. Kabler asked Mr. Trainer if he had anything further to discuss with the Commission. Mr.

Trainer had nothing further, thanked the Commission and left the meeting.

Commission members next reviewed minutes for corrections and additions.

Mr. Czako made a motion to approve the minutes of hearing HTZC 18-02, dated October 29,

2018, as corrected. Mr. Nied seconded the motion. Mr. Kabler asked if there was any

discussion on the motion. Being none, Mr. Kabler asked for a voice vote on the motion, all aye. Motion carried.

Ms. Manson made a motion to approve the minutes of the October 8, 2018 workshop meeting as corrected. Mr. Czako seconded the motion. Mr. Kabler asked if there was any discussion on the motion. Being none, Mr. Kabler asked for a voice vote on the motion, all aye. Motion

carried.

Mr. Kabler stated at the Trustees October meeting the Trustees reassured the public present

that the Zoning Inspector has the authority to enforce the Zoning Resolution. Mr. Trainer will ask the Trustees to pass a resolution on the property at 5180 Smothers Road requesting that

the Prosecutor's Office initiate court action.

Commission members then discussed the reformatting to the Zoning Resolution. Commission members will address the concerns discussed tonight and Mr. Czako will bring in a copy of the portion he had worked on for members to review at the November workshop meeting.

Mr. Kabler asked if there was anything further to come before the Commission. Being nothing further at this time, Mr. Kabler adjourned the November 5, 2018 monthly meeting at 8:57 p.m.
