Chairman, Mike Kabler, called hearing HTZC 18-03 for Jack and Catherine Decker to order at 7:45 p.m. Mr. Kabler asked for a roll call of members.

Members Present: Robin Lobenstein, Joni Manson, Mike Kabler, Alan Czako, Tom Nied

Alternate Absent: Bill Needham

Secretary: Sherrie Steele

Mr. Kabler introduced Commission members and the secretary. Mr. Kabler explained the rules and procedures for the hearing. Mr. Kabler opened the hearing and asked the secretary to read the public notice.

PUBLIC NOTICE

The Harlem Township Zoning Commission is being asked to consider the following:

Jack S. Decker and Catherine G. Decker, 5501 Miller Paul Road, Westerville, Oh;o 43082, are

seeking to rezone 5.284 acres from Current Zoning AR-1 Agricultural Residential to Proposed

Zoning FR-1 Farm Residential.

There is no physical address for the property. The parcel is listed as Tract 6, Parcel ID# 316-340- 01-005-001 on Robins Road between 12543 Robins Road and 12681 Robins Road.

The hearing will be held on Monday, December 3, 2018 at 7:45 p.m. at the Harlem Township

Firehouse, 3883 South State Route 605, Galena, Ohio 43021. The hearing Is open to the public. The application and accompanying documents are on display at the rear door of the firehouse.

Mr. Kabler asked if the application was on the correct form. The secretary stated the

application was on the correct form. Mr. Kabler asked if the applicants had signed the

application. The secretary stated the applicants had signed the application. Mr. Kabler asked what the specific zoning request was. The secretary stated to rezone 5.284 acres from current zoning AR-1 Agricultural Residential to FR-1 Single Family Residential.

Mr. Kabler asked Commission members if the correct legal description had been furnished In

text and map. Mr. Clase provided Commission members with a corrected deed. The secretary stamped and dated the corrected deed as "Received December 3, 2018".

Mr. Kabler asked the secretary if the adjacent, adjoining, contiguous property owners had been notified of the hearing. The secretary stated the adjacent, adjoining, contiguous property

owners had been notified by first class mail. The secretary stated no letters had been returned.

Mr. Kabler asked if there were any non-notified property owners present. There were no non­notified property owners present. Mr. Kabler asked if there were any waivers for non-notified property owners. The secretary stated there were no waivers.

Mr. Kabler asked Commission members if there were any other errors noted. Commission

members had found no other errors.

Mr. Kabler asked for the recommendation of Delaware County Regional Planning Commission. The secretary stated Delaware County Regional Planning Commission recommended approval of the application without conditions.

Mr. Kabler asked if the Review Team had been utilized. Mr. Kabler stated the Review Team had been utilized for this application.

Mr. Kabler opened the hearing to Commlssion members and asked if they had any questions for the applicant.

Mr. Kabler stated Mr. Decker had provided a copy of the Power of Attorney for his wife, Catherine Decker, who could not be present at the hearing tonight.

Mr. Nied asked about the driveway that leads back to Mr. Decker's son's property. Mr. Decker stated the driveway would be a shared driveway.

Mr. Kabler asked if there were any further comments from Commission members.

Ms. Manson stated that in as much as application HTZC 18-03 conforms to the intent of the Harlem Township Comprehensive Plan and appears to meet all applicable aspects of the Harlem Township Zoning Resolution, 1 move that the Harlem Township Zoning Commission recommend to the Harlem Township Board of Trustees said application be approved. Mr. Nied seconded the motion. Mr. Kabler stated he had a motion and a second and asked if there was any discussion on the motion. Being none, Mr. Kabler asked for a roll call vote on the motion. Robin Lobenstein, aye. Joni Manson, aye. Mike Kabler, aye. Alan Czako, aye. Tom Nied, aye. Motion carried.

Mr. Kabler stated the application would now be forwarded to the Trustees. The Trustees are scheduled to meet on December 19, 2018 and will set a date for their hearing at that time. Their hearing will be within 30 days of receipt of the application. If the Trustees approve the application there will be a 30 day waiting period.

Mr. Kabler asked if there were any final comments. Being none, Mr. Kabler adjourned hearing HTZC 18-03 at 8:06 p.m.
