Mr. Kabler stated the Commission would begin tonight with the presentation of an application to rezone.
Horace Henriot presented the Commission with an original and 11 copies of an application to
rezone 2.156 acres from AR-1 Agricultural Residential to FR-1 Farm Residential. Mr. Henriot
stated he just realized he did not include the deed with the application. Mr. Hen riot will drop off 12 copies ofthe deed to the secretary on Tuesday.
Mr. Hen riot presented the secretary with check# 1099 for$ 500.00 for the application fee and check# 129 for$ 269.50 for the acreage fee.
Commission members assigned the application #HTZC 19-01 and set the hearing date for
February 4, 2019 at 7:00 p.m. Mr. Kabler advised Mr. Hen riot that his wife must be present the night of the hearing or he must present a Power of Attorney on her behalf.
Commission members reviewed minutes for corrections and additions. Mr. Czako made a
motion to approve the minutes ofthe December 3, 2018 monthly meeting as corrected. Ms.
Lobenstein seconded the motion. Mr. Kabler asked if there was any discussion on the motion. Being none, Mr. Kabler asked for a voice vote on the motion, all aye. Motion carried.
Ms. Manson made a motion to approve the December 10, 2018 workshop meeting as
corrected. Mr. Nied seconded the motion. Mr. Kabler asked if there was any discussion on the motion. Being none, Mr. Kabler asked for a voice vote on the motion, all aye. Motion carried.
Ms. Manson made a motion to approve the minutes of the Zak Preliminary meeting as
corrected. Mr. Czako seconded the motion. Mr. Kabler asked if there was any discussion on
the motion. Being none, Mr. Kabler asked for a voice vote on the motion, all aye. Motion
Commission members next discussed the abstract of the Harlem Township Zoning Resolution. Once the proposed changes the Commission is currently working on are finalized, the abstract will need to be updated.
Commission members discussed the Planned Commercial District for the storage units on
Fancher Road. The property owner has three years to complete the project. Commission
members discussed when the three year time line begins as the application had gone to
referendum. The State of Ohio Supreme Court had ordered the Board of Elections to remove the referendum from the November 2018 ballot. Commission members decided the date the Court Order was filed by the Ohio Supreme Court should be the date the three year period
Commission members wanted it noted in the minutes that 30 days after the Trustees' hearing unless an application goes to referendum in which case the timetable starts when the Board of Elections certifies the results of the referendum or if a court challenge is made the three year timeline starts on the date of the court's final decision.
Mr. Czako stated in the future the Chair should inform an applicant that after the 30 day
waiting period, ifthe application goes to the Board of Elections for referendum it is out of the hands of the Trustees and is in the hands of the Board of Elections and/or the Court.
Mr. Kabler stated Karen Coffman has requested a Review Team meeting in regards to the 101 acres on State Route 605 between Fancher Road and Bevelheimer Road. Mr. Kabler asked
Commission members if they would be available to meet with Ms. Coffman on Friday, January 11, 2019 at 4:00 p.m. Mr. Kabler and Ms. Manson will meet with Ms. Coffman on Friday.
Mr. Kabler asked ifthere was anything further to come before the Commission. Being nothing further at this time, Mr. Kabler adjourned the January 7, 2019 monthly meeting at 9:05 p.m.
