February 4, 2019

Chair, Mike Kabler, called the February 4, 2019 monthly meeting to order at 7:30 p.m. Mr. Kabler asked for a roll call of members.

Members Present: Robin Lobenstein, Joni Manson, Mike Kabler, Alan Czako, Tom Nied

Alternate Present: Bill Needham

Secretary: Sherrie Steele

Zoning Inspector: Not Present

Public Present: None Present

Commission members began tonight's meeting with the review of minutes. Ms. Manson made a motion to approve the minutes of the January 7, 2019 Organizational meeting as corrected. Mr. Czako seconded the motion. Mr. Kabler asked if there was any discussion on the motion. Being none, Mr. Kabler asked for a voice vote on the motion, all aye. Motion carried.

Mr. Kabler stated at this time the Commission would recess the February 4, 2019 monthly meeting until after the Preliminary Meeting scheduled to begin at 7:45 p.m.

Mr. Kabler called the February 4, 2019 monthly meeting out of recess at 7:50 p.m. Mr. Kabler asked for a roll call of members.

Public Present: Ida W. Misenheimer, 16147 Needles Road, Johnstown, Ohio 43031

Mr. Kabler asked Mr. Misenheimer if he had any questions for the Commission. Mr. Misenheimer stated he owned 5 ½ acres on Needles Road. Mr. Misenheimer stated he would like to build an 18' x 36' detached garage on the property.

Mr. Kabler advised Mr. Misenheimer to contact the Township Zoning Inspector for any questions and to request a zoning permit. Mr. Kabler stated the Zoning Inspector is currently deployed but is expected to return on February 15, 2019. Mr. Kabler gave Mr. Misenheimer contact numbers for Mr. Trainer. Mr. Misenheimer stated he would contact Mr. Trainer a few days after his return as he would not be able to begin work on the garage until Spring.

Commission members returned to the review of minutes. Ms. Manson made a motion to approve the minutes of the January 7, 2019 monthly meeting as corrected. Mr. Czako seconded the motion. Mr. Kabler asked if there were any questions on the motion. Being none, Mr. Kabler asked for a voice vote on the motion, all aye. Motion carried.

Mr. Czako made a motion to approve the minutes of the January 14, 2019 workshop meeting as corrected. Mr. Nied seconded the motion. Mr. Kabler asked if there was any discussion on the motion. Being none, Mr. Kabler asked for a voice vote on the motion, all aye. Motion carried.

Commission members discussed the process of notifying adjacent, adjoining, contiguous property owners. Commission members discussed how the addresses are obtained. Questions were brought up regarding the actual property address, the property owner's address and the tax duplicate address. Commission members again discussed the matter of the Zoning Inspector preparing the map and list of adjacent, adjoining, contiguous property owners for the applicant and the liability this places the Township under. Mr. Kabler will draft a letter to the Trustees in regards to their concerns.

Mr. Kabler asked the secretary for an update on the reformatting ofthe Zoning Resolution. The secretary will meet with Mr. Czako to address concerns on the updating. The secretary will

have the draft copy ready for review at the March 4, 2019 monthly meeting.

Mr. Kabler referred to New Business and discussed with Commission members that it was time for the 5 year review of the Township Comprehensive Plan. Commission members may need to postpone work on proposed language updates to address revising the Comprehensive Plan.

Ms. Manson stated she would like for the Commission to finish updates to Article XXVIII before they begin work on the Comprehensive Plan. Ms. Manson would like for that language to go to application when the Commission submits the reformatting of the Zoning Resolution for

application.

Commission members then discussed Zoning Fees for rezoning applications. Mr. Nied had

looked at Genoa, Oxford and Brown Townships for the fees who charge a$ 400.00 application fee and a $100.00 per acre fee. Orange Township charges a flat fee of$ 3500.00 for property

less than 17 acres and a$ 600.00 application fee with$ 175.00 acreage fee for property over 17 acres.

Mr. Kabler passed out a chart he had created for Commission members to review with possible suggestions for zoning fees. Commission members discussed having a base fee for rezoning

and the same fee per acres regardless of the size of the property. Commission members

discussed the need for an analysis from the Township of current costs and future costs to

establish the fees. Mr. Kabler indicated he would draft a letter to the Trustees regarding zoning fees.

Mr. Kabler asked if there was anything further to come before the Commission. Mr. Nied made a motion to adjourn. Mr. Czako seconded the motion. Mr. Kabler asked for a voice vote on the motion, all aye. Motion carried. The February 4, 2019 monthly meeting was adjourned at 9:37.
